These Terms of Use ("Terms") govern your use of the Pace mobile app and the Pace pages on anthonylabs.net (together, the "Service"), provided by Anthony Labs LLC ("we", "us", "Anthony Labs"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Pace requires an account, created through Sign in with Apple or Google. You are responsible for keeping access to that sign-in secure, and for what happens under your account. You must be at least 13 years old to use Pace. Tell us at hello@anthonylabs.net if you believe your account has been used without your permission.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Pace on devices you own or control. These Terms don't transfer any ownership of the app or its content to you.
Some of what Pace can do requires Pace Essentials, an auto-renewing subscription sold through the Apple App Store.
Your use of Pace is also subject to Apple's Standard End User License Agreement, and our Privacy Policy explains what the subscription means for your data.
If your subscription ends, nothing you have made is deleted. Folders you own become read-only: your plans and history stay visible, and you can subscribe again to make them editable and runnable. Folders that somebody else owns and shared with you are unaffected by your subscription, because they are covered by theirs.
The folders, plans, steps and sessions you create in Pace are yours. You keep ownership of them. You grant us only the permission we need to operate the Service: to store your content, to show it to the people you have shared a folder with, and to send the notifications you have asked for.
You are responsible for the content you put into Pace and for having the right to share it.
Pace is built for shared use, and sharing has consequences you should understand before you do it:
You agree not to:
This one matters more in Pace than in most apps, so we would rather be blunt about it.
Pace sends alerts through Apple's push notification service and your device's own alarm features. Delivery depends on things outside our control: a network connection, your device's battery and Focus settings, iOS's own scheduling, and Apple's infrastructure. Alerts can be late, or can fail to arrive.
So do not rely on Pace where a missed or late alert would be dangerous or costly: medication timing, medical or clinical procedures, anything involving a vehicle, industrial or laboratory processes, or any other safety-critical use. Pace is a tool for organising time, not a medical device, not a life-safety alarm, and not professional advice of any kind.
We may update, change, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we'll revise the "Last updated" date above, and your continued use of the Service means you accept the updated Terms. If a change materially reduces what a paid subscription gets you, we'll say so in the app.
You can stop using Pace at any time, and delete your account from inside the app. Deleting your account removes your profile and the folders you own, along with the plans and sessions in them. So if you own a folder other people depend on, transfer it before you go. We may suspend or terminate an account that breaks these Terms.
Pace is distributed through the Apple App Store, and your use is also subject to Apple's terms. Apple is not responsible for the app and is not a party to these Terms, though Apple may benefit from them as a third party where applicable. Apple has no obligation to provide support for Pace.
The Pace name, logo, design, and software are owned by Anthony Labs and protected by intellectual-property laws. Nothing in these Terms gives you the right to use our branding without our prior written permission.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, that notifications will arrive on time, or that it will produce any particular result.
To the maximum extent permitted by law, Anthony Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or related to your use of the Service. To the extent any liability cannot be excluded, it is limited to the amount you paid us for the Service in the twelve months before the claim, or USD $50, whichever is greater.
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Washington.
